1. Overview

These Terms of Service ("Terms") govern your access to and use of nostalgicways.com and purchases from Nostalgic Ways. Throughout these Terms, "we," "us," and "our" refer to Nostalgic Ways, and "you" refers to any visitor, customer, or user of the Services.

By visiting the website, placing an order, creating an account, or using any part of the Services, you agree to these Terms and our Privacy Policy, Refund Policy, and Shipping Policy. If you do not agree, do not use the Services.

Our store is hosted by Shopify, which provides the ecommerce platform used to offer products and Services to you.

2. Eligibility and Acceptable Use

You must be legally capable of entering a binding agreement in your jurisdiction to make a purchase. You may not use the Services for unlawful, fraudulent, abusive, or unauthorized purposes; interfere with the website's security or operation; introduce malicious code; scrape or exploit the Services; impersonate another person; or violate another party's rights.

We may refuse service, cancel orders, restrict access, or terminate accounts when reasonably necessary to protect customers, Nostalgic Ways, Shopify, service providers, or the integrity of the Services.

3. Products and Availability

We make reasonable efforts to describe and display products accurately. Colors and appearance may vary by screen, lighting, manufacturing process, printing, or hand-finishing. Handmade, hand-dyed, vintage-inspired, small-batch, and limited-release items may have natural variations that are not defects.

Products, quantities, prices, promotions, and availability may change without notice. We may limit quantities, discontinue products, correct errors, or cancel an order if an item is unavailable or incorrectly listed. If we cancel a paid order, we will refund the affected amount to the original payment method.

4. Prices, Payments, and Billing

Prices are displayed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other disclosed fees are calculated at checkout. You agree to provide current, complete, and accurate billing, payment, contact, and shipping information.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges. Orders are not accepted until payment is approved and we confirm or begin processing the order.

5. Orders

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may decline, limit, or cancel an order because of suspected fraud, payment issues, inventory errors, pricing mistakes, resale activity, policy violations, or other legitimate business reasons.

Orders begin processing quickly, so changes or cancellations are not guaranteed. Our Refund Policy and Shipping Policy are incorporated into these Terms.

6. Shipping and Risk

We currently ship only within the United States. Processing times and delivery estimates are not guarantees. Shipping is subject to carrier operations and circumstances outside our reasonable control. Responsibility for an accurate and deliverable address rests with the customer. 7. All-Sales-Final Policy

Except where required by law or expressly provided for damaged, defective, or incorrect items in our Refund Policy, all sales are final and we do not accept returns or exchanges. Review all product and sizing information before purchasing.

8. Intellectual Property

The website and its content—including the Nostalgic Ways name, original artwork, logos, graphics, photographs, videos, product designs, text, layout, and branding—are owned by or licensed to Nostalgic Ways and are protected by applicable intellectual-property laws. No content may be copied, reproduced, modified, distributed, sold, published, or commercially used without prior written permission, except as permitted by law.

9. Reviews and User Content

If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to submit it and that it is truthful, lawful, and does not infringe another party's rights. You grant Nostalgic Ways a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and share that content for operating, improving, and promoting the business, subject to applicable law and our Privacy Policy.

We may remove user content that is unlawful, deceptive, abusive, infringing, or otherwise inappropriate.

10. Third-Party Services and Links

The Services may rely on or link to third-party tools, payment providers, social platforms, apps, or websites. We are not responsible for third-party content, availability, security, products, or practices. Your use of third-party services may be governed by separate terms and policies.

11. SMS Marketing Terms

By providing your mobile number and affirmatively opting in, you agree to receive recurring automated promotional and personalized marketing text messages from Nostalgic Ways or its messaging service providers. Messages may include product announcements, drop reminders, special offers, cart reminders, and related marketing content. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

To stop receiving marketing texts, reply STOP. For help, reply HELP or contact nostalgicwaysteam@gmail.com. After opting out, you may receive one final message confirming your request. You agree to provide a valid mobile number that you control and to notify us if the number changes. Carriers are not liable for delayed or undelivered messages. Availability may vary by carrier and location.

Participation in the messaging program is also governed by our Privacy Policy, including the section titled "SMS Marketing and Mobile Information."

12. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and products are provided on an "as is" and "as available" basis except for any express promises stated in these policies. We do not warrant that the website will always be uninterrupted, secure, or error-free. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Nostalgic Ways and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the Services or products. Where liability cannot be excluded, our aggregate liability will not exceed the amount you paid for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by law.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Nostalgic Ways and its owners, employees, contractors, and service providers from claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another party's rights.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Any dispute will be brought in a court of competent jurisdiction serving Lackawanna County, Pennsylvania, unless applicable law provides another required venue.

16. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later.

17. Changes to These Terms

We may update these Terms from time to time. Revised Terms will be posted with an updated effective date. Changes apply prospectively unless otherwise stated or required by law.
